Terms of Service

1. The service

Avatorial drafts social-media content in your own writing voice and publishes it to LinkedIn and Reddit only after your explicit per-post approval, using the platforms' official APIs. These terms form the agreement between Nextarp B.V. and the customer (the organisation or individual creating a workspace).

2. Accounts and workspaces

• You sign in with your organisation's Microsoft Entra ID; you are responsible for the accuracy of account information and for actions taken under your credentials.
• Connecting a LinkedIn or Reddit account requires that the account is yours (or, for company pages, that you are authorised to manage it).

3. Subscriptions and billing

• Plans, prices and included quotas are listed on the pricing page. Prices exclude VAT.
• The trial is 14 days, full-featured, without payment details. After the trial, drafting pauses until a subscription starts; your data is retained 60 days.
• Billing is monthly or annual in advance via Stripe. Upgrades prorate immediately; downgrades and cancellations take effect at the end of the paid period. Statutory withdrawal rights for consumers are honored.
• AI draft quotas reset monthly and pool across a workspace. Approving and publishing existing drafts is never blocked by quota.

4. Your content

• You own your corpus, drafts, and published posts. You grant us the licence needed to operate the service (store, process, generate, publish on your instruction).
• Approving a draft is your editorial act: you confirm the content is accurate, lawful, and yours to publish. AI output can contain errors — review before you approve is the product's core design, and your responsibility.
• We may refuse or suspend processing of content that is unlawful, infringing, or abusive.

5. Acceptable use

• No attempts to bypass the human-approval flow, impersonate others, or connect accounts you do not control.
• You must comply with LinkedIn's and Reddit's terms and each subreddit's rules; Avatorial gives you compliant tooling, but what you approve and where you post it is your call.
• No reselling of the service without a written agreement.

6. Platform dependencies

Publishing depends on third-party platform APIs that we do not control. If a platform changes or revokes API access, affected features may be limited or converted to manual handoff; we will communicate material changes. Such changes do not constitute breach, but if a core feature you pay for becomes unavailable for more than 30 days you may cancel with a pro-rata refund of the unused period.

7. Availability and support

We target high availability but the service is provided without a guaranteed SLA on self-serve plans (Enterprise SLAs by agreement). Support via email; priority response on Business and Enterprise plans.

8. Liability

To the extent permitted by law, our aggregate liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect damages, for the content you approve and publish, or for actions taken by platforms against your accounts based on the content you post. Nothing limits liability for intent or gross negligence.

9. Termination

You may cancel at any time (effective end of period). We may suspend or terminate for material breach with notice. On termination, export is available for 60 days, after which workspace data is deleted per the privacy policy.

10. Governing law

Dutch law applies; competent court is Rotterdam, without prejudice to mandatory consumer protections. If a provision is invalid, the remainder stands.

11. Changes to these terms

We may update these terms with 30 days' notice by email for material changes; continued use after the effective date constitutes acceptance.
